Terms of Service

These terms govern every reservation with Chicago Executive Charters. They cover how you book and pay, what the driver and vehicle will do, what happens if plans change, and who is responsible for damage, delays or disputed charges. Read them before you book, because paying for a trip means you accept them.

1. Accepting these terms

By booking a reservation, paying for a trip, using this site, or riding in one of our vehicles, you agree to these terms and to our Refund & Cancellation Policy and Privacy Policy, which form part of this agreement. If you book for a group or on someone else’s behalf, you confirm you are authorised to accept these terms for everyone in your party, and you are responsible for making sure they follow them. If you do not agree, do not book or ride.

2. What we provide

Chicago Executive Charters provides chartered group ground transportation with a professional chauffeur — Sprinter limos, luxury SUVs, stretch limousines, shuttles, party buses and charter buses — for weddings, corporate travel, airport transfers, nights out and similar trips in the Chicago metropolitan area. We supply a vehicle and driver for the period and itinerary you reserve. We do not provide tour-guide, security, childcare or chaperone services, and the driver is not responsible for supervising passengers.

2.1 Licensed and insured carrier

Depending on the vehicle, route and date, your trip is performed either by Chicago Executive Charters under its own authority or by a licensed affiliate carrier we engage to fulfil your reservation. In every case the carrier performing your trip holds the commercial automobile liability insurance and operating authority required for that service under applicable Illinois and federal law, including the Illinois Commercial Transportation Law administered by the Illinois Commerce Commission and the applicable Federal Motor Carrier Safety Regulations. Proof of the insurance and authority covering your trip is available on request. Nothing on this site or in these terms promises any specific certificate, coverage amount or regulatory status beyond what the carrier performing your trip is actually required to and does carry at the time of your trip.

3. Booking, payment and pricing

3.1 Reservations are paid and confirmed

Reservations are made through our hosted booking form and are confirmed only when payment is completed and you receive a written booking confirmation from us by email. Submitting a request, receiving a quote or starting the booking form does not reserve a vehicle. A reservation is paid in advance: you book by paying.

3.2 Payment processing and card information

Payments are handled by our third-party payment processor, which accepts major credit and debit cards and supported digital wallets. Your payment is subject to that processor’s terms and privacy policy. Chicago Executive Charters does not collect or store your full card number. By submitting payment you authorise us and our processor to charge the card you provide for the full reservation amount and for any additional charges permitted under Section 3.4 and Section 5.

3.3 Prices, taxes and gratuity

The price you see and approve at the time of booking is the quoted price for the services described in your confirmation. Driver gratuity and applicable taxes are included or itemised exactly as stated in your booking confirmation. The quoted price does not include charges that depend on what happens during your trip, such as overtime, additional stops, tolls, parking, airport or venue access fees, or cleaning. Those are described in Section 3.4 and Section 5. We bill what you were quoted plus only the additional charges you actually incur.

3.4 Holds, authorisations and additional charges

We or our payment processor may place a temporary authorisation hold on your card at or before the time of your trip. By booking, you authorise Chicago Executive Charters to charge the card on file, after the trip, for additional amounts you incur, including overtime beyond your reserved hours; additional or unscheduled stops or itinerary changes you request; tolls, parking and access fees we pay on your behalf; and damage or cleaning fees under Section 5. Where practical we will tell you about additional charges before billing them. Overtime is billed in the increments stated in your confirmation and begins when your reserved time ends.

3.5 Disputed charges and chargebacks

If you believe a charge is incorrect, contact us first at info@chicagoexecutivecharters.com or (773) 923-0220 so we can review it. Initiating a chargeback or payment dispute with your card issuer for charges that are valid under these terms and our Refund & Cancellation Policy — including non-refundable cancellation charges, no-show fees, overtime, and damage or cleaning fees you actually incurred — is a breach of these terms, and we reserve the right to contest such disputes with documentation and to recover the charge and reasonable costs of collection.

4. Passenger conduct and prohibited items

You and everyone in your party agree to behave lawfully and safely. The following are prohibited in our vehicles:

  • Illegal drugs or controlled substances, and any illegal activity.
  • Smoking, vaping or open flames of any kind.
  • Weapons of any kind, except as carried by law enforcement acting in an official capacity.
  • Standing through an open roof or window, hanging out of the vehicle, or any conduct that distracts the driver or endangers passengers or others.
  • Damaging, defacing or removing any part of the vehicle or its equipment.

The driver may refuse to begin, may end, or may divert any trip without refund if a passenger is engaging in illegal, unsafe, threatening or abusive conduct, is dangerously intoxicated, or violates these terms. You are responsible for the conduct of everyone in your party.

4.1 Occupancy limits and safety

Each vehicle has a maximum passenger capacity, stated in your booking, which you may not exceed. Passengers must remain seated while the vehicle is in motion to the extent seating is provided, and must wear seatbelts where the vehicle is equipped with them and where required by law. You agree to follow the driver’s reasonable safety instructions at all times.

4.2 Alcohol policy

Chicago Executive Charters does not sell or provide alcohol. Alcohol may be consumed in a vehicle only where the vehicle and trip are of a type that legally permits it, only by passengers aged 21 or older, and only if you have arranged it as part of your booking. You are solely responsible for verifying the age of everyone in your party and for ensuring no one under 21 consumes alcohol. You assume all liability arising from alcohol consumption by your party and agree to indemnify Chicago Executive Charters for any claim arising from it. If a passenger appears to be under 21 and is consuming alcohol, or if alcohol consumption becomes unsafe, the driver may stop the trip without refund.

5. Damage and cleaning fees

You are responsible for the cost of repairing any damage to the vehicle, and for cleaning beyond ordinary wear, caused by you or anyone in your party during your trip. This includes a cleaning fee for sickness, spills, broken glassware or excessive trash, and the cost of repairing torn, burned or broken interior, equipment or fixtures. The amount for any damage or cleaning charge is provided at the time the charge is assessed, with documentation available on request. By booking you authorise us to charge the card on file for these amounts under Section 3.4.

6. Delays, weather, breakdowns and vehicle substitution

We are not liable for delays or failures to perform caused by events beyond our reasonable control, including severe weather, road or traffic conditions, accidents, road closures, construction, acts of government, strikes, civil disturbance, utility or network failures, public-health emergencies, or other events of force majeure. We are also not liable for delays caused by you, such as a late or unready party, address errors, or itinerary changes.

If your assigned vehicle becomes mechanically unavailable, we may substitute a vehicle of equal or greater capacity and class to fulfil your reservation, and that substitution satisfies our obligation. If we are unable to provide a vehicle at all due to circumstances within our control, your sole remedy is a refund of amounts paid for the unperformed service, as described in our Refund & Cancellation Policy. Weather and force-majeure cancellations are addressed in that policy.

7. Limitation of liability

To the fullest extent permitted by Illinois law, Chicago Executive Charters is not liable for any indirect, incidental, consequential, special, exemplary or punitive damages, or for lost profits, lost wages, missed events, missed flights or connections, or lost opportunities, arising out of or related to your reservation, your trip, any delay, or these terms, whether based in contract, tort or any other theory, even if we were advised of the possibility of such damages.

To the fullest extent permitted by Illinois law, our total liability to you for all claims arising out of or related to a reservation or trip will not exceed the total amount you actually paid us for that reservation. Nothing in this section limits or excludes our liability for death or bodily injury to passengers, or any liability that cannot be limited or excluded under applicable Illinois law, including the duty of care Illinois imposes on passenger carriers. The limitations above apply only to economic and consequential losses and do not apply to claims for personal injury. This section does not affect the insurance Chicago Executive Charters carries as a licensed passenger carrier.

8. Assumption of risk and indemnification

Group transportation involves inherent risks. To the extent permitted by law, you assume the ordinary risks of travel for yourself and your party. You agree to indemnify, defend and hold harmless Chicago Executive Charters and its members, employees, drivers and agents from any claims, damages, losses, fines and reasonable attorneys’ fees arising out of your or your party’s breach of these terms; damage to the vehicle or injury to any person caused by you or your party; alcohol consumption by your party; or any illegal or prohibited conduct by you or your party. This section does not require you to indemnify us for our own negligence or wilful misconduct where the law prohibits it.

9. Lost items

Chicago Executive Charters is not responsible for items left in or lost from a vehicle. If you believe you left something behind, contact us promptly at info@chicagoexecutivecharters.com or (773) 923-0220 and we will make a reasonable effort to locate and return it. We may charge a reasonable fee to ship a recovered item back to you. We are not liable for the loss, theft or damage of any personal property.

10. Accessibility and accommodation requests

Chicago Executive Charters is committed to serving customers with disabilities. If you need a wheelchair-accessible vehicle or another accommodation, tell us when you book or contact us in advance at info@chicagoexecutivecharters.com or (773) 923-0220 so we can do our best to meet your needs. Advance notice helps us arrange suitable equipment. If you encounter an accessibility barrier on this site, contact us and we will work with you to provide the information or assistance you need.

11. Text and email messages

When you book, we send transactional and informational messages by text and email so your trip runs smoothly, such as your booking confirmation and receipt and ride-status updates. By providing your mobile number at booking, you consent to receive these service messages from Chicago Executive Charters and our messaging providers at that number, including by automated means. Message frequency varies by trip and message and data rates may apply. This consent is for service messages about your reservation and is not a condition of any unrelated marketing.

You can opt out of text messages at any time by replying STOP to any message, or by contacting us at info@chicagoexecutivecharters.com. Reply HELP for help. After you opt out we may still contact you by email or phone where necessary to provide a trip you have booked. Carriers are not liable for delayed or undelivered messages. See our Privacy Policy for how we handle your information.

12. Intellectual property

This site and its content, including text, graphics, logos, the Chicago Executive Charters name and marks, images and design, are owned by or licensed to Chicago Executive Charters and protected by intellectual-property laws. You may use the site only to learn about and book our services. You may not copy, reproduce, republish, scrape or create derivative works from the site or its content without our prior written permission.

13. Changes to these terms

We may update these terms from time to time. The current version, with its last-updated date, is always posted here, and the version in effect when you complete a booking governs that booking. Material changes take effect when posted. Your continued use of the site or our services after a change means you accept the updated terms.

14. Governing law and venue

These terms and any dispute arising out of them or your trip are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules. Subject to Section 15, you and Chicago Executive Charters agree that the exclusive venue for any dispute is the state or federal courts located in Cook County, Illinois, and you consent to the personal jurisdiction of those courts. Nothing in this section waives any right you have under applicable consumer-protection law.

15. Dispute resolution

If you have a concern, contact us first at info@chicagoexecutivecharters.com or (773) 923-0220. Most issues are resolved quickly and informally. If a dispute cannot be resolved informally, it will be resolved in the state or federal courts located in Cook County, Illinois, as provided in Section 14.

16. General

If any provision of these terms is held unenforceable, the rest remains in effect, and the unenforceable provision is modified to the minimum extent needed to make it enforceable. Our failure to enforce a provision is not a waiver of it. These terms, together with our Refund & Cancellation Policy and Privacy Policy, are the entire agreement between you and Chicago Executive Charters regarding our services.
